Terms and Conditions
1. Scope of Application
These General Terms and Conditions apply to all services provided by Muuttopalvelu M. Kähäri to its clients, both in Finland and internationally.
2. Services and Performance
2.1 Assignments
Assignments comprise all work and operations where Muuttopalvelu M. Kähäri or its subcontractors provide transport, relocation services, or moving supplies to the client.
2.2 Cancellation of an Assignment
For domestic relocations, the client has the right to cancel the order free of charge no later than 7 days prior to the agreed commencement of work. If cancelled later, Muuttopalvelu M. Kähäri reserves the right to charge a cancellation fee corresponding to 30% of the agreed price. For international relocations, the cancellation must be made free of charge at least 14 days prior to the scheduled start date; otherwise, a fee of 30% of the agreed price will be charged.
2.3 Force Majeure
Muuttopalvelu M. Kähäri shall notify the client without delay of any occurrence of force majeure. Force majeure entitles either party to cancel the assignment; however, the client remains liable for work already performed. Muuttopalvelu M. Kähäri is not liable for any secondary or auxiliary expenses incurred by the client due to force majeure.
2.4 Additional Work and Discrepancies
If the required scope deviates substantially from the agreed oral or written order (for example, if the actual inventory exceeds the stated volume or the client requests out-of-scope tasks), Muuttopalvelu M. Kähäri reserves the right to invoice for these additional works separately.
2.5 Specialized Installations
Muuttopalvelu M. Kähäri is under no obligation to disassemble or reassemble furniture, nor to undertake electrical or plumbing installations (such as disconnecting or connecting light fixtures or washing machines), unless explicitly agreed upon in advance.
2.6 Exceptionally Heavy Items
The handling and transit of safes, upright pianos, grand pianos, and other exceptionally heavy objects must always be agreed upon separately with Muuttopalvelu M. Kähäri.
3. Claims and Liability
3.1 Notice Period for Claims
If the client's property or belongings sustain damage during an assignment carried out by Muuttopalvelu M. Kähäri, a written claim must be submitted within 14 days of completion. Failure to submit a timely claim relieves Muuttopalvelu M. Kähäri of all liability.
3.2 Substantiating Damage
The client must clearly substantiate and document the damage incurred and its causal link to the moving operation. If the damage cannot be proven, Muuttopalvelu M. Kähäri is released from liability.
3.3 Carrier Liability and Insurance
All shipments are governed by the Finnish Road Transport Contracts Act (for domestic routes) and the CMR Convention (for international transports). Statutory carrier liability is capped at:
- Domestic transport: Up to €20 per kilogram of gross weight missing or damaged.
- International transport: Up to 8.33 SDR per kilogram of gross weight missing or damaged (SDR is an international IMF currency basket unit).
The client can enhance financial coverage by purchasing separate, full-value transit insurance.
3.4 Limitations for Electronic and Consequential Damage
Liability does not extend to internal electronic malfunctions or data losses, such as the corruption or loss of files or software, nor to operational disruptions resulting from disconnecting or connecting cables and equipment.
3.5 Exclusions of Liability
Liability on the part of Muuttopalvelu M. Kähäri may be reduced or excluded entirely if the damage is shown to have arisen from any of the following:
- Items or working premises were not properly packed or protected. Packing and protective wrapping remain the client's responsibility unless agreed otherwise.
- Electronic equipment suffers an internal fault without any visible external signs of transit damage.
- Belongings are inherently sensitive to temperature or humidity variations (such as house plants).
- Fragile pre-existing condition, poor wear, or faulty assembly prevents safe handling via standard moving methods.
3.6 Sentimental Value and Indirect Loss
Liability does not cover sentimental value, consequential damages, indirect business interruption, or financial losses.
4. Storage Services
4.1 Storage Agreements
Storage covers all arrangements wherein the parties agree on storing the client's goods in facilities managed by Muuttopalvelu M. Kähäri.
4.2 Prohibited Goods
Hazardous, flammable, toxic, or perishable goods, as well as items vulnerable to temperature changes (such as live plants), may not be placed in storage.
4.3 Termination for Overdue Rent
If invoiced storage fees remain unpaid for more than 30 days past due, Muuttopalvelu M. Kähäri reserves the right to terminate the storage contract with immediate effect.
4.4 Right of Retention and Liquidation
Muuttopalvelu M. Kähäri holds a right of lien and retention over stored property until all outstanding storage fees and related contractual claims are satisfied. If fees remain unsettled and items are left uncollected despite formal notices, Muuttopalvelu M. Kähäri is entitled to liquidate the items to cover outstanding receivables pursuant to applicable law.
5. Invoicing and Payment Terms
5.1 Storage Invoicing
Storage fees are billed monthly in advance or as stipulated in the individual agreement.
5.2 Interim Storage During Transit
Where relocation services involve interim storage, an advance payment of at least 50% of the total relocation quote becomes due immediately upon the start of interim storage.
5.3 Payment Terms and Interest on Late Payment
Relocation services are primarily invoiced upon completion. The payment term is 7 days from the invoice date, unless agreed otherwise in writing. Overdue balances accrue late payment interest in accordance with the Finnish Interest Act.
5.4 Advance Payment
If credit checks reveal payment defaults or negative entries registered against the payer, Muuttopalvelu M. Kähäri reserves the right to require payment in advance or sufficient collateral prior to commencing any work.
